Course Goal / Objective
The aim of this course is to analyze the basic principles of collateral law, legal regulations and current developments in practice at an advanced level. Students will gain the competence to analyze the function and types of collaterals in debt relations and the legal problems encountered in practice.
Course Content
Within the scope of the course, various types of guarantees such as pledges, sureties, bank letters of guarantee, guarantee agreements and insurance guarantees will be discussed and a comparative evaluation will be made within the national and international legal framework. In addition, misuse of guarantees, prohibition of abuse of right, judicial decisions and current academic discussions will be emphasized.
