Course Goal / Objective

This lecture aims to provide an in-depth analysis of human behavior referred to as a crime by breaking it down into its components within the framework of general criminal law. It focuses on developing expertise in core topics of general crime theory, such as legal definition (typicality), act, unlawfulness, fault, criminal liability, attempt, complicity, and concurrence of offenses. The objective is to equip students with the knowledge and skills to analyze legislation, judicial decisions, and current practices in light of general crime theory, to critically assess debates in these areas, and to propose informed solutions.

Course Content

With the lecture on General Theory of Crime and Special Forms of Crime, the foundations of criminal liability are addressed through the detailed analysis of the elements of crime—legal definition (typicality), act, unlawfulness, fault, criminal liability, attempt, complicity, and concurrence of offenses—within the framework of the Turkish Penal Code (TPC), comparative legal systems, relevant legislation, and judicial decisions.

LO03 Compares the provisions included in the general provisions of the Turkish Penal Code (TCK) with those in comparative legal systems such as Germany, Italy, France, etc.
LO04 Explains the concepts included in the general theory of crime, such as legal definition (typicality), intent, negligence, act in criminal law, consequence, causality, grounds of justification, mens rea, culpability, attempt to commit a crime, participation in a crime, and concurrence of crimes.
LO05 Explains how controversial issues in general criminal law are addressed in practice, particularly in the decisions of the Supreme Court (Yargıtay).
LO06 Explains how the institutions found in the general provisions of the first book of the Turkish Penal Code No. 5237 are regulated in the abolished Turkish Penal Code No. 765, and discusses their positive and negative aspects from the perspective of the ideal legal framework.
