Course Goal / Objective

The aim of this course is to provide knowledge about the fundamental concepts and principles of energy law, as well as the legislation regulating the energy market. Within the scope of the course, the legal framework of Türkiye’s energy markets (including electricity, natural gas, petroleum, renewable energy, and nuclear energy markets) is analyzed, and the functioning of relevant laws, regulations, and regulatory authorities such as EPDK is examined. It is intended that students learn about administrative processes in the energy sector and the resolution of legal disputes.

Course Content

The course content begins with the definition and scope of energy law and, within this framework, sets out the fundamental regulations of international, EU, and Turkish energy law. Legal regulations are examined in detail according to energy sources (such as fossil fuels, renewable energy, and nuclear energy). The liberalization of energy markets, licensing, tariff-setting, and the principles of competition law in the sector are addressed. In addition, the duties and powers of regulatory authorities (such as EPDK, the Competition Authority, and the Nuclear Regulatory Authority) and the Ministry of Energy are discussed. The fundamental principles of energy law are covered throughout the course. Furthermore, case law analyses are conducted based on the decisions of the Council of State concerning energy law disputes.
