Course Goal / Objective
The primary objective of this course is to examine the fundamental principles and practical implementation of road transport law within the framework of the Turkish Commercial Code (TCC) and the CMR Convention. It aims to provide students with a practical legal perspective by analyzing how the carrier’s liability, concepts of loss and damage, and the principle of limited liability (SDR) are interpreted in light of the Court of Appeals and international judicial rulings.
Course Content
Within the scope of the program, the formation of the transport contract, the function of the waybill, loading and unloading obligations, and the carrier's liability for loss, damage, and delay are addressed. In particular, the implementation differences between the TCC and CMR, the grounds for exemption from liability, the concept of wilful misconduct, and recourse mechanisms are analyzed with a focus on current high court precedents.
