Course Goal / Objective
The aim of this course is to examine the principle of freedom of contract in labor law in theoretical and practical dimensions; to analyze within which limits the freedom of will of the parties is valid in the context of individual labor contracts and to evaluate the legal, social and economic justifications of these limitations. In addition, the course aims to develop normative and critical perspectives on the limitations of freedom of contract in students.
Course Content
Within the scope of the course, the concept of freedom of contract will first be addressed within the framework of private law and labor law. Then, the effects of elements such as the imperative structure of labor law, the power imbalance in the employee-employer relationship, public order and the principle of the social state on freedom of contract will be examined. Legislation on the subject in national and comparative law, high court decisions and doctrinal approaches will be examined; solution proposals for the problems encountered in practice will be developed.
