Course Goal
Identifying the types of collateral and examining in detail the surety, guarantee and hypothec contracts.
Course Content
Examining the establishment of the suretyship contract, the mutual rights and obligations of the parties and the termination of the contract within the framework of the provisions of the Turkish Code of Obligations No. 6098. Turkish Code of Obligations m.581 etc. as a personal guarantee contract. Examining especially the Swiss Law of Obligations and the amendments made in this regard within the scope of Supreme Court practice and Swiss Law, in comparison with other personal guarantee agreements, together with the terms and provisions of the agreement regulated in its provisions. In addition, revealing the types of in-kind collateral and examining the hypothec contract in detail.
Course Precondition
Students are informed about the property regimes other than the legal property regime.
